Terms of Service

Please read these terms before using Waypoint Diary. They explain the service, your choices, and our shared responsibilities.

1. Agreement to these terms

These Terms of Service govern your use of the Waypoint Diary mobile application and this website (together, the “Service”). By downloading, accessing, or using the Service, you agree to these terms. If you do not agree, do not use the Service.

2. The Service

Waypoint Diary helps you create and organize personal memories, including notes, photos, voice recordings, locations, trips, collections, and reflections. Some features are available entirely on your device. Optional account, sync, storage, and sharing features may require an internet connection and acceptance of additional provider terms.

3. Your content and responsibility

You retain ownership of the content you create in Waypoint Diary. You are responsible for ensuring that you have the rights and permissions needed to add, store, export, or share that content. Do not use the Service to infringe others’ rights, violate applicable law, or share content that is unlawful, harmful, or deceptive.

You are responsible for protecting your device, account credentials, and exported diary files. Location, photo, and voice content may be sensitive; use care when sharing it.

4. Optional sync and sharing

Device-only mode does not require a Waypoint Diary account or private sync. If you enable optional cross-device sync, you authorize us to process the information necessary to provide that feature. If you publish a share link, anyone with the link may be able to access the selected shared projection until you revoke it or it expires. Do not include information in a shared item that you do not want recipients to see.

5. Third-party services

The Service may integrate with third-party services you choose to use, such as map, authentication, cloud storage, or app-store providers. Those services operate under their own terms and privacy policies. We are not responsible for their availability, security, or practices.

6. Changes, availability, and updates

We may update, modify, suspend, or discontinue parts of the Service. We may also update these terms when necessary. The current version will be posted on this page with an updated date. Your continued use after changes take effect means that you accept the revised terms.

7. Disclaimers

The Service is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, or suitable for every purpose. Map data, location results, device sensors, and third-party services can be inaccurate or unavailable. Do not rely on Waypoint Diary for emergency navigation, safety-critical decisions, or professional advice.

8. Limitation of liability

To the extent permitted by law, Waypoint Diary and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or use resulting from your use of or inability to use the Service.

9. Termination

You may stop using the Service at any time. You may delete local content and, where available, request deletion of a synced account. We may suspend or terminate access when reasonably necessary to protect the Service, users, or legal rights.
